Mombirds is a two-sided marketplace connecting service providers with customers. Our platform facilitates transactions between individuals seeking services ("Customers" or “Nesters”) and individuals offering services ("Service Providers" or “Flock”). Mombirds is operated by Via Ladera LLC.

User Accounts

Registration: To use our Services, you must create an account. You agree to provide accurate, current, and complete information during the registration process.

Account Security: You are responsible for maintaining the security of your account. Notify us immediately of any unauthorized use of your account.

Communication Preferences: By creating an account or participating in the beta test program, you consent to receive communications from Mombirds via text messages and emails regarding your account, services, and platform updates. You can manage these preferences or opt out at any time by contacting us.

Services

Listing Services: Service Providers may list their services on Mombirds. Listings must be accurate, lawful, and comply with our guidelines.

Booking Services: Customers can browse listings and book services. By booking a service, you agree to abide by the terms set by the Service Provider.

Fees: Mombirds may charge fees for certain transactions. These fees will be clearly communicated to you before completing the transaction.

Beta: Should you choose to be a part of our beta testing program, you acknowledge that the platform is in development and may contain errors or bugs. Your feedback is valuable and may be used to improve the platform. Participation in the beta program is at your own discretion and risk.

User Responsibilities

Compliance: Users must comply with all applicable laws and regulations when using Mombirds.

Communication: Users agree to communicate respectfully and professionally with each other.

Feedback: Users may provide feedback on their experiences. Feedback must be truthful and constructive.

Intellectual Property

By posting content, you grant Mombirds a non-exclusive, royalty-free license to use, display, reproduce, modify, and distribute that content solely for the purposes of operating and improving the Mombirds platform.

Trademarks: Mombirds' trademarks, logos, and branding are the property of Mombirds. Users may not use these without permission.

Termination

Mombirds reserves the right to terminate or suspend accounts for violations of these Terms or for any reason at our discretion.

Limitation of Liability: Mombirds acts solely as a platform to connect Customers and Service Providers. We are not responsible for the conduct, quality, or legality of the services provided. Users engage with each other at their own discretion and risk. Mombirds is not liable for any damages resulting from the use of our Services.

Governing Law

These Terms are governed by the laws of the State of Texas, United States of America.

Dispute Resolution: Any disputes arising from the use of our platform will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, to be held in Austin, Texas.
