Mombirds Terms of Service

Welcome to Mombirds. These Terms of Service ("Terms") govern your use of the Mombirds website, services, and platform (collectively, the "Services"). By accessing or using Mombirds, you agree to these Terms.

Introduction

Mombirds is a managed home support service that connects families in the Austin, Texas area with vetted independent helpers for in-home household tasks. We handle matching, scheduling, coordination, and payment processing so families receive consistent, reliable support without the overhead of managing a household worker directly.

While we screen and coordinate helpers, Mombirds does not supervise work performed in the home and is not responsible for day-to-day service delivery. Helpers are independent contractors, not employees of Via Ladera LLC.

Mombirds is operated by Via Ladera LLC ("we," "us," or "our").

User Accounts

Registration: To access certain features of the Services, including booking, scheduling, payments, and the client task portal, you may be required to create an account. You agree to provide accurate, current, and complete information and keep it updated.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.

Communication Consent: By using Mombirds, you consent to receive communications via email, phone, and text message related to your account, bookings, scheduling, task coordination, billing, and service updates. Text messaging is a core part of how Mombirds coordinates services. Message and data rates may apply. You may opt out of marketing messages, but you will continue to receive service-related communications necessary to provide the Services.

Client Task Portal & Platform Tools

Task Portal: Mombirds may provide clients with access to a task portal, dashboard, or similar tools to submit and manage household tasks, preferences, notes, scheduling details, and access instructions.

Client Responsibility: You are responsible for ensuring all information submitted is accurate, current, and appropriate. Mombirds may rely on this information to coordinate services and is not responsible for errors or omissions.

Platform Changes: We may update or modify these tools at any time.

Services

In-Home Support: Mombirds matches families with helpers for tasks including laundry, tidying and home resets, kitchen resets, organizing, meal prep, kids and family space resets, and basic outdoor tasks.

Scope Limitations: We do not provide errand running, driving, childcare, or elder care. All services occur in the client’s home.

Helper Vetting: We may conduct interviews, reference checks, and/or background screenings. This process reduces risk but does not guarantee outcomes.

Independent Contractors: Helpers are independent contractors. Mombirds is not responsible for their performance, conduct, or service outcomes beyond coordination and screening.

Availability: We do not guarantee replacement helpers in the event of cancellations or changes.

Payments & Billing

Payment Processing: Payments are processed securely via Stripe. By booking services, you authorize Mombirds and its payment processor to charge your payment method for all applicable fees.

Automatic Billing: Your payment method will generally be charged approximately 48 hours after a session is confirmed complete. You have that window to flag issues.

Disputed Charges: If a session did not occur as scheduled, contact us within 48 hours. We will review and reverse charges if appropriate.

Payment Method: You agree to keep a valid payment method on file. If payment fails, we may pause or suspend Services.

Rates: Session rates may change with 14 days’ notice.

Cancellation Policy

Cancellations: Cancellations made at least 48 hours in advance are not charged. Cancellations made within 48 hours may incur a charge of up to one hour of service. Repeated late cancellations may result in account review or suspension.

User Responsibilities

General Conduct: You agree to communicate respectfully with helpers and Mombirds staff.

Accuracy: You agree to provide accurate and complete information when requesting services.

Environment: You agree to provide a safe working environment, secure valuables, and disclose pets, hazards, or relevant home conditions.

Access: You agree to ensure your helper has access to the home at the scheduled time.

Compliance: You agree to comply with all applicable laws.

Direct Hire Restriction

Restriction: You agree not to directly hire or engage a Mombirds helper outside the platform for 12 months following your last session.

Fee: If you do, a placement fee of $500 will apply. If you are interested in a direct arrangement, contact us to discuss options.

Intellectual Property

Content: You retain ownership of content you submit. By submitting content, you grant Mombirds a non-exclusive, royalty-free license to use it to operate and improve the Services.

Branding: “Mombirds” and related branding are owned by Via Ladera LLC and may not be used without permission.

Limitation of Liability

Scope: Mombirds facilitates connections but does not guarantee service outcomes.

Exclusions: We are not liable for helper performance, scheduling issues, cancellations, property damage, loss, theft, injuries, or incidents occurring in the home.

Cap: Our total liability is limited to the amount you paid in the six (6) months prior to the claim. We are not liable for indirect or consequential damages.

Termination

User Termination: You may stop using the Services at any time.

Company Termination: We may suspend or terminate accounts at our discretion, including for violations of these Terms or unsafe behavior.

Disclaimer

Service Disclaimer: We strive to provide a high-quality experience but do not guarantee uninterrupted or error-free service.

Governing Law

Law: These Terms are governed by the laws of the State of Texas.

Disputes: Disputes will be resolved through binding arbitration in Austin, Texas under the rules of the American Arbitration Association.

Changes to Terms

Updates: We may update these Terms from time to time. Continued use of the Services constitutes acceptance of any updates.
